YOUR AGREEMENT WITH IMAGINE THE MAGIC TRAVEL
By utilizing our services, you indicate your acceptance of the following terms and conditions on behalf of yourself and all members of your travel group.
1. DOCUMENT VERIFICATION
Upon receiving your documents, please review them for accuracy. It is essential to match the names on your documents with your government-issued ID. If you have any questions, feel free to contact us.
2. AGENT REPRESENTING SUPPLIERS
Imagine the Magic Travel and our independent travel advisors (referred to as "we" or "us") act as sales agents for various service providers mentioned in your itinerary or confirmation, such as airlines, hotels, car rental companies, tour operators, and cruise lines (referred to as "Suppliers"). We cannot be held responsible for the actions or failures of the Suppliers, including schedule adherence, service provision, refunds, financial defaults, or honoring future trip credits. It is important to note that your travel plans may be disrupted or canceled by the Supplier, a government entity, or a third party beyond our control. You acknowledge that the Supplier's own policies regarding cancellation, rebooking, and refunds, as governed by applicable laws, will determine your rights and remedies, including the right to receive a refund. We do not possess special knowledge about the financial status of the Suppliers, and we bear no liability for recommending trip credits instead of refunds.
3. TRAVEL RISKS
We do not assume responsibility or liability for the actions or omissions of parties not under our control, acts of God, unsafe conditions, terrorism, health hazards (including pandemics), illness, weather hazards, or the suitability of any part of a trip for individuals with disabilities. We have no specialized knowledge regarding travel risks or conditions at destinations. For information concerning such risks, we recommend visiting the State Department travel website at www.travel.state.gov. To access medical and health-related information, please refer to the Centers for Disease Control website at www.cdc.gov/travel. For specific information related to COVID-19, we suggest visiting IATA's COVID-tracking site in addition to the State Department's website. Ultimately, it is your personal decision to travel, and you assume all risks associated with current travel recommendations and restrictions regarding COVID-19. It is your responsibility to understand and comply with all requirements and restrictions when traveling. These may include health affidavit forms, health screenings, temperature checks, travel reason affidavit forms, online travel authorizations, airline safety and health requirements (such as health forms, screenings, and face coverings), in-country requirements (such as periodic temperature checks, quarantine, and face coverings), and visas. Failure to meet these requirements and/or restrictions may result in fines, quarantine, or deportation at your own expense.
4. CHECK-IN
For domestic flights, check-in should be done at least 1 to 1½ hours before departure, while international flights require 2 to 3 hours due to enhanced security measures. It is advisable to allow extra time before the scheduled departure to account for any unforeseen circumstances. Failure to arrive within the specified check-in time may result in denied boarding.
5. PROOF OF IDENTITY
All passengers must present a valid photo ID, such as a passport or other state or government-issued identification. IMPORTANT INFORMATION FOR DOMESTIC AIR TRAVELERS: The Federal Real ID Act enforces stricter security standards for state-issued driver's licenses and other identification forms. Federal agencies will not accept non-compliant identification for official purposes. Starting May 3, 2023, every air traveler must present Real ID-compliant identification to board a domestic flight. If you possess a non-compliant driver's license, you need to present an acceptable alternate form of identification, such as a valid U
.S. passport. To avoid disruptions to your travel plans, it is strongly recommended to consult the Department of Homeland Security (www.dhs.gov/real-id) to determine if your state-issued identification is Real ID-compliant and which alternate forms of identification are accepted at airports. 6. PASSPORTS AND VISAS
A valid passport is required for international travel. Additional requirements, such as visas, may be necessary depending on the destination. Non-U.S. citizens have different immigration requirements. It is your responsibility to contact the appropriate consulate(s) for information. Without proper identification, passport, and necessary visas, you will not be allowed to depart. Feel free to contact us if you need assistance with passports or visas. You are fully responsible for checking and verifying all passport, visa, vaccination, and entry requirements for your destination and connecting points. This also includes checking conditions related to health, safety, security, political stability, and labor or civil unrest at your destination. Many countries require passports to be valid for at least six months beyond the entry date. Some countries may deny entry to individuals with criminal convictions. Additionally, some countries may require parental consent for minors to travel.
7. EXCURSION AND PROMOTIONAL FARES
Most discounted fares have specific restrictions. Changing carriers, flights, times, or routes may result in the carrier requiring payment of a full fare. It is advisable to seek agency or airline assistance before making any changes.
8. TIMES, FLIGHTS, AND FARES
Times, flights, and fares are based on the current tariffs, which are subject to change without prior notice.
9. PRICE INCREASES
Travel arrangements involving airlines and cruises are subject to additional price increases imposed by Suppliers and/or governments, even after your purchase is complete. By agreeing to these terms, you consent to such price increases and authorize the use of your credit or debit card for payment. Suppliers have their own cancellation penalties, terms, and conditions, which may bind you regardless of whether you receive notice of these terms.
10. PRICE DROPS
If a Supplier reduces the price of a trip after your booking, we will make an effort to assist you in rebooking, subject to the Supplier's policies and any applicable fees. However, we cannot guarantee refunds or successful rebooking.
11. LOWEST FARES
We strive to secure the most affordable fare suitable for your travel needs, based on available space at the time of booking and the information accessible to us. However, due to airline fare deregulation, we cannot guarantee that the fare indicated on the ticket will be the lowest available at the time of departure. If you wish to verify any newly introduced fares that align with your specific travel requirements, please contact us before your departure.
12. TOUR, CRUISE, AND PACKAGE PRICES
Tour, cruise, and package prices are subject to change without notice due to currency fluctuations, tariff adjustments, or increased operational costs. Group tours/packages are typically based on a minimum number of passengers. If the passenger count falls below the required minimum, a surcharge may apply to all passengers.
13. RESERVATION RULE VIOLATIONS
You agree not to purchase tickets containing flight segments that you do not intend to use, such as "point-beyond," "hidden-city," or "back-to-back" tickets. Furthermore, you agree not to purchase round-trip tickets solely for one-way travel. Airlines generally prohibit such practices, and therefore, we cannot guarantee that the airline will honor such tickets. If you fail to utilize one of the flights in your reservation, the airline may cancel your remaining itinerary and potentially revoke your frequent flyer points. You agree to indemnify us against any claims from the airline for the fare difference between
your actual itinerary and the value of the purchased ticket(s).
14. CREDIT CARD MERCHANT
If we are the merchant on your credit card transaction, please note that our services involve counseling, facilitating the sale, and paying the Supplier. In the event that a Supplier fails to provide the service or ceases operations, you must seek recourse directly from the Supplier, not from us. You agree not to initiate a chargeback or unauthorized refund request against us. Any dispute in this regard may result in you being responsible for all legal fees incurred by us.
15. CHANGES ENROUTE
If your travel plans change during your journey, please consult your travel agent or airline carrier for information on charges, changes, and applicable fees.
16. OVERBOOKING
Airline flights may be overbooked. If you are denied boarding due to overbooking, you may be entitled to compensatory payment. The rules governing compensation for denied boarding are available at all ticket counters.
17. CANCELLATIONS AND REFUNDS
We reserve the right to charge processing fees for refunds, cancellations, and other services. To modify or cancel your flight itinerary, you must do so before the originally scheduled departure. No value remains after departure. If you have guaranteed hotel or car reservations that you wish to cancel, you must contact the vendor directly and adhere to their cancellation policy. We are not responsible for any losses incurred due to your failure to travel or comply with the change or cancellation policies of travel vendors.
18. HOTELS
Hotel reservations are usually confirmed on a guaranteed payment basis. If you need to cancel or change your plans, please notify your hotel(s) within the specified time period determined by the hotel. Cancellation policies may vary depending on the property.
19. TRAVEL INSURANCE RECOMMENDATION
We strongly recommend purchasing travel insurance. The extent of coverage for financial loss under circumstances such as a pandemic, pre-existing medical conditions, and other policy exclusions will be determined by the terms of the insurance policy. Please consult the insurance carriers directly for detailed information. It is important to note that trip insurance or waivers provided by Suppliers may not include coverage for insolvency. Any description or representation of insurance made by our staff does not constitute a binding assurance or promise about the insurance. By agreeing to these terms, you release us from any liability related to your decision not to purchase travel insurance or any denial of claims by a travel insurer, including those related to Covid-19 or any other claim under the policy.
20. SUPPLIER BANKRUPTCIES
If an airline or other Supplier declares bankruptcy, they are not obligated to honor reservations made prior to the bankruptcy or refund tickets issued before the bankruptcy. Travel agents are not authorized to refund tickets for airlines that have declared bankruptcy. Funds given to a travel agent become the property of the airlines immediately, and we are legally required to comply with airline orders. In the event of an airline bankruptcy, the airline may continue operations, reduce services, or cease operations entirely. Other airlines may accept passengers under limited circumstances, while some may refuse to accept any passengers from the bankrupt carrier. There are comprehensive travel insurance plans available to protect passengers in case of airline bankruptcies.
21. REFUNDS IN CASE OF CANCELLATION
If a Supplier cancels your travel services, and it's not your fault or due to your cancellation, we will promptly refund all the amounts you have paid for the services that were not provided. This refund will be issued unless you inform us otherwise in writing after the cancellation. However, this policy does not apply if we have already transferred the payment to another registered wholesale seller of travel or a Supplier, and they fail to deliver the agreed-upon transportation or service without offering a refund. In such cases, we will provide you with a written statement, along with bank records proving the payment disbursement, as well as evidence of the wholesale seller's current registration if the payment was made to them.
